The products we offer are by no means medicines and merely nutritional supplements.

 

Please always read the package leaflet and/or packaging carefully before use and if in doubt, contact your doctor or pharmacist.

 

 


Article 1: General provisions

 

The ZOEMTRITION online store offers its customers the opportunity to purchase products online.

These General Terms and Conditions (“Terms”) apply to all items from the ZOEMTRITION range and every purchase that the customer places with ZOEMTRITION.

 

The mere fact of placing an order on the ZOEMTRITION website leads to acceptance of the underlying terms and conditions of sale, which the customer has taken note of before placing any purchase.

 

The customer accepts that these Terms and Conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) conditions, even if they stipulate that they are the only ones applicable.

 

After placing an order, the customer will receive a summary of the order by e-mail, as well as a copy of the General Terms and Conditions as a PDF.

 

 

Article 2: Price

 

All prices stated are in euros and always include VAT. If transport, reservation or administrative costs are charged, this will be stated separately depending on the choices made in this regard. The price stated in the order confirmation is the final price, including all additional costs, such as packaging, storage and transport and VAT. The price statement applies exclusively to the items as described verbatim.

 

 

The accompanying photo is always intended for decorative purposes and may contain elements that are not included in the price. ZOEMTRITION is not liable if customs duties or other local costs or taxes are charged for the delivery of goods and services outside the European Union. Such duties, costs or taxes are borne by you as the buyer and, if necessary, you are also obliged to make declarations in this regard to the competent authorities in the country of delivery.

 

 

ZOEMTRITION reserves the right to adjust its prices at any time, without any prior notice. Goods and services are invoiced based on the price in force at the time of registration of the order, subject to availability and subject to administrative errors.

 

 

The goods remain the property of ZOEMTRITION until full payment of the price. Despite this retention of title, the risk of loss or damage passes to the customer upon delivery of the goods. Any promotions are valid until the indicated date or in any case for a maximum of one month after announcement. They cannot be combined with each other.

 

Discount vouchers cannot be exchanged for cash value and are neither fully nor partially refundable.

 

 

Article 3: Client

 

Every visitor to the ZOEMTRITION site has the option to register as a user. This access is personal and reserved for legally competent individuals. The user undertakes not to pass on his login details to third parties, thus preventing misuse. In the event of (suspected) unlawful use, ZOEMTRITION has the right to delete the registration of this user, without prejudice to the right to recover any damages from the user.

 

 

Article 4: Offer

 

Each offer is only open to customers residing in the European Union. The offer is valid while supplies last and can be adjusted or withdrawn at any time by ZOEMTRITION.

 

 

If you have specific questions about sizes, availability, colors, delivery time or delivery method, please feel free to contact ZOEMTRITION customer service. ZOEMTRITION is entitled - without giving reasons - to refuse orders, to adjust delivery times, to split deliveries, or to attach other conditions to the delivery.

 

Despite the fact that the website has been compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors or is not up to date.

 

 

ZOEMTRITION is only bound by an obligation of means with regard to the accuracy, topicality or completeness of the information provided. ZOEMTRITION is under no circumstances liable in the event of material errors, typesetting or printing errors.

 

ZOEMTRITION offers products that should be used with the utmost caution. We recommend that you always read the packaging or leaflet carefully before use and, if in doubt, contact your doctor or pharmacist.

 

 

The items are exclusively intended for normal private use. Prescription or non-prescription medicines are not available through ZOEMTRITION.

 

 

Article 5: Payment

 

The customer has the option to purchase the items from the ZOEMTRITION range online. The purchase is completed when the customer receives a confirmation email from ZOEMTRITION. The items are delivered to the customer at the chosen delivery address and within the delivery period indicated on the website. Payment is made via a payment method as proposed on the site or as agreed between ZOEMTRITION and the customer.

 

 

Each order will only be definitively confirmed after acceptance by the banking institution. In the event of refusal by the banking institution, the order will be automatically canceled and the customer will be informed by email.

 

 

Article 6: Retention of title

 

The delivered items remain the exclusive property of ZOEMTRITION until full payment has been made by the customer. However, the risk for loss or damage passes to the customer upon delivery. If necessary, the customer undertakes to inform third parties of ZOEMTRITION's retention of title, for example to anyone who would seize the items that have not yet been fully paid for.

 

 

Article 7: Complaints

 

Any visible damage and/or qualitative shortcoming of an item or other shortcoming in delivery must be reported immediately to ZOEMTRITION, under penalty of forfeiture of any rights. If you have a complaint about a product or service or the way in which it is offered, you must also report it as soon as possible. To file a complaint, you must inform ZOEMTRITION of your complaint via a clear notice of default. You can use the contact form on the website for this purpose. If you make use of this option, you will receive an acknowledgment of receipt and an appropriate solution to your complaint by e-mail. Complaints will be answered within five working days from the date of receipt. If a complaint requires a longer processing time, you will receive a confirmation of receipt and an indication of when you can expect an answer and possible solution.


In case of an ongoing dispute:

 

In the event of an out-of-court settlement of a dispute, the Consumer Ombudsman Service of the Federal Government is authorized to receive any request for out-of-court settlement of consumer disputes. The latter will in turn process the application itself or refer it to the competent entity. In the event of disputes of a cross-border nature, you can also use the European Union's online dispute resolution platform, accessible via the following link: http://ec.europa.eu/odr.

 

 

Article 8:

 

Warranty In the context of the current agreement, ZOEMTRITION only guarantees the soundness of the delivery of the products based on the information provided by the customer. ZOEMTRITION never guarantees the achievement of a result. The usability and quality of the products are clarified in the leaflet or manufacturer's packaging. It is up to the customer to read this information and, if there is any doubt or uncertainty, to seek expert advice from a doctor or pharmacist. All products offered on ZOEMTRITION are registered in Belgium according to Belgian law. ZOEMTRITION cannot be held responsible in any way for failure to respect laws and regulations in force in the host country.

 

 

ZOEMTRITION uses the legal minimum warranty period of two years for consumer goods. This legal guarantee applies to all tangible movable objects. The legal warranty can be invoked if the non-conformity of the delivered good is established within two years of the delivery of the good to you as a consumer. If the good becomes defective within the first six months after delivery, the defect is assumed to have existed since delivery. If the defect in the good is discovered more than six months after delivery, you as a consumer must prove that the good was non-compliant at the time of delivery. Any defect that is a direct result of fall, impact or water damage automatically leads to the expiration of the right to legal warranty. In the event of such defects, you must inform ZOEMTRITION as soon as possible. You have the right to free repair or replacement of the good, depending on what is possible and reasonable.

 

 

 

 

 

Only if the repair or replacement is excessive or impossible or cannot be carried out within a reasonable period, you are entitled to a price reduction or termination of the sales agreement. If it is a minor defect, you cannot demand the termination of the contract. The two-year warranty period cannot be extended.

 

 

Article 9: Withdrawal period

 

The provisions of this article only apply to customers who purchase items online in their capacity as consumers. You have the right to withdraw from the agreement within a period of 14 (fourteen) days without giving reasons. The withdrawal period expires 14 (fourteen) days after the day on which you or a third party designated by you, who is not the carrier, acquires physical possession of the goods. In the event that the ordered goods are delivered separately, the withdrawal period expires 14 (fourteen) days after the day on which you or a third party designated by you, who is not the carrier, acquires physical possession of the last good.

 

 

The right of withdrawal cannot be exercised in the event of: - the delivery of goods that spoil quickly or have a limited shelf life; - the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery. These articles fall under art. VI. 53 on market practices and consumer protection from the Code of Economic Law outside the application of the right of withdrawal. As a consumer you also have the right to cancel the purchase before shipment. This is possible for the entire purchase or for part of it, as well as for medicines and medical devices. Please contact one of the ZOEMTRITION employees as soon as possible.

 

To exercise the right of withdrawal, you must inform ZOEMTRITION of the decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or e-mail). You can use the attached model withdrawal form for this, but you are not obliged to do so. You can also fill in the model withdrawal form or another clearly formulated statement electronically and send it via the contact form on our website. If you make use of this option, we will immediately send you confirmation of receipt of your revocation on a durable medium (e.g. by e-mail). Model form I hereby inform you that I revoke our agreement regarding the sale of the following goods. Ordered on ... Received on ... Consumer's name ... Consumer's address ... Consumer's signature (only when this form is submitted on paper) ... Date ... To comply with the withdrawal period, it is sufficient to enter your to send you a communication regarding your exercise of the right of withdrawal before the withdrawal period has expired. If you revoke the agreement, you will receive all payments you have made up to that time, including delivery costs (with the exception of any additional costs resulting from your choice of a different method of delivery than the cheapest standard delivery offered by us) without delay and in any case, no later than 14 (fourteen) days after we have been informed of your decision to withdraw from the agreement. We will refund you using the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in any case, you will not be charged any fees for such refunds. We may wait with reimbursement until we have received the goods back or you have demonstrated that you have returned the goods, whichever comes first. You must return or hand over the goods to us or to one of our branches without delay, but in any case no later than 14 (fourteen) days after the day on which you communicate your decision to withdraw from the contract to us. You are on time if you return the goods before the period of 14 (fourteen) days has expired. The direct costs of returning the goods are at your expense. Only items that are in the original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase, can be returned.

 

 

Article 10: Liability

 

ZOEMTRITION is not responsible for any technical defects in the packaged products or for incorrect statements in the manufacturer's leaflet. ZOEMTRITION can also not be held liable for damages of all kinds resulting from improper use of the marketed products. Also not for possible changes in the products made by the manufacturers. ZOEMTRITION's liability, if any, will be limited solely to the value of the product in question, determined according to the date of sale. Liability cannot be questioned for minor errors or omissions that could have persisted despite the precautions taken in the presentation of the goods. The photos on the site are shown for information purposes only. A change to the packaging or contents of a product cannot be invoked in the event of deviation compared to the photo on the site. The customer undertakes to read the manufacturer's information on or in the packaging of the product. It is this information that the customer must respect (including dosages and contraindications).

 

 

This site also contains links to other Internet sites. ZOEMTRITION cannot be held responsible for current or future content on these sites. Nor for the content of sites that have a link to the ZOEMTRITION site.

 

 

Article 11: Privacy

 

ZOEMTRITION attaches importance to your privacy. ZOEMTRITION is legally obliged to include your personal data in its customer database. As a user, you have the right to inspect your personal data as known to ZOEMTRITION at any time, free of charge and upon request. You can also have your data changed or deleted from ZOEMTRITION's customer base at any time, after presenting a valid proof of identity, and object to the use of your data for marketing purposes. Article 12: Affect of validity - Non-renunciation

 

If any provision of these Terms and Conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. The failure at any time by ZOEMTRITION to enforce any of the rights set forth in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of those rights.

Article 14: Changes to conditions

 

These general terms and conditions of sale of ZOEMTRITION may be supplemented by other terms and conditions that are explicitly referred to. In the event of any conflict, these Terms and Conditions shall prevail. ZOEMTRITION may change these Terms at any time without further notice. Any purchase after the change constitutes acceptance by the customer of these new Terms.

 

 

Article 15:

Evidence The customer accepts that electronic communications and backups can serve as evidence.

 

 

Article 16: Intellectual property rights

 

Texts, drawings, photos, images, data, logos, trade and domain names, brands, etc. belong to ZOEMTRITION and third parties and are protected by intellectual rights. It is prohibited - without the prior consent of ZOEMTRITION - to store, reproduce, modify, make public, distribute, send, sell or in any other way transfer the information or grant rights thereto to third parties, under penalty of compensation.

 

 

Article 17: 

Applicable law - Competent court Belgian law applies, with the exception of the provisions of private international law regarding applicable law and with the exception of the Vienna Convention on Contracts for the International Sale of Goods. In the event of any disputes, the courts in Hasselt have exclusive jurisdiction. However, ZOEMTRITION and the customer undertake to try to settle any dispute through an amicable settlement. If this does not work, the above is valid.
